This Terms of Service Agreement ("Agreement") is a formal legally binding instrument executed between the individual or entity accessing the Service ("User") and James Turner (XPDevs) ("Proprietor"). By initiating any interaction with the Genesis AI application, its associated infrastructure, or any proprietary logic modules contained therein, the User explicitly affirms their irrevocable consent to the terms, conditions, and covenants set forth in this document.
The User acknowledges that continued use of this Service constitutes a waiver of any right to pursue collective legal action. This Agreement contains stringent limitations on the Proprietor's liability and specific indemnification obligations binding upon the User.
In this Agreement, the following terms shall have the meanings ascribed to them:
The User acknowledges that the Service represents the result of significant creative and technical investment by the Proprietor. All components of the Genesis-AI architecture, including but not limited to the proprietary logic structures and their associated compiled binary files, are the exclusive property of James Turner (XPDevs). No license is granted to the User except as explicitly provided in Section 2.2.
The Proprietor grants the User a limited, revocable, non-exclusive, and non-transferable license to access the Service for personal, creative, or legitimate professional use. This license does not encompass the right to distribute, modify, or create derivative works of the Proprietary Assets.
The User is strictly prohibited from attempting to decompile, disassemble, or otherwise attempt to derive the source logic or binary construction of the Service. Any attempt to extract or re-engineer compiled binary assets for external analysis, reproduction, or use in third-party environments shall constitute a material breach of this Agreement and will result in immediate legal action and termination of access.
The Service is delivered as an experimental implementation of automated logic systems. The Proprietor provides no representation or warranty regarding the consistency, accuracy, or suitability of the Service for any specific purpose. The User accepts all outputs generated by the Service at their own peril.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JAMES TURNER (XPDEVS) BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA CORRUPTION, OR SYSTEM FAILURE, ARISING FROM THE USE OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE LEGAL THEORY ASSERTED.
The User covenants and agrees to utilize the Service in strict accordance with all applicable statutes and regulations. The User shall not engage in any activity that compromises the integrity, security, or stability of the Service infrastructure.
The User is expressly forbidden from utilizing the Service for the purpose of generating, facilitating, or disseminating content related to:
The Service employs local storage mechanisms to facilitate session continuity and user preference persistence. The User acknowledges that this data resides exclusively on their local hardware. The Proprietor assumes no liability for the loss, corruption, or unauthorised recovery of such data from the User's device.
The User grants the Proprietor a perpetual, irrevocable, royalty-free, worldwide license to utilize anonymised User Input for the purposes of system calibration, safety filter enhancement, and the overall improvement of the Genesis-AI ecosystem.
The User agrees to indemnify, defend, and hold harmless James Turner (XPDevs) from any and all third-party claims, liabilities, damages, and costs (including reasonable legal fees) arising from (i) the User's breach of this Agreement, (ii) the User's violation of any law or the rights of a third party, or (iii) the User's misuse of the Service.
This instrument constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, or agreements, whether written or oral.
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
This Agreement shall be governed by and construed in accordance with the laws of England and Wales. All disputes arising hereunder shall be subject to the exclusive jurisdiction of the Courts of England and Wales located in London.
