1. DEFINITIONS

For the purposes of this Agreement, the following terms shall have the
meanings specified below:
"Agreement" - This Terms of Service document, including all referenced
sections and any subsequent amendments.
"Service" - The Genesis AI web application, including all user interfaces,
underlying logic systems, and associated components.
"Proprietor" - James Turner (XPDevs), the legal entity responsible for the
development, maintenance, and operation of the Service.
"User" - Any individual or entity that accesses or utilizes the Service.
"User Content" - Any data, text, images, or other materials submitted by the
User to the Service.
"Proprietary Assets" - All intellectual property associated with the Service,
including binary files, JSON modals, and system logic.

2. ACCEPTANCE OF TERMS

By accessing or using the Service, the User acknowledges and agrees to be
bound by the terms and conditions set forth in this Agreement. If the User
does not agree to these terms, the User must not access or use the Service.
Use of the Service constitutes electronic execution of this Agreement. The
User warrants that they have the legal capacity to enter into this Agreement.

3. INTELLECTUAL PROPERTY

The Service and all Proprietary Assets are the exclusive intellectual property
of James Turner (XPDevs). All rights not expressly granted herein are reserved.
The User is granted a limited, non-exclusive, non-transferable license to use
the Service for personal and professional purposes.
The following activities are strictly prohibited:
- Distribution of the Service or Proprietary Assets
- Modification of the Service or Proprietary Assets
- Reverse engineering or decompilation
- Creation of derivative works
- Use for commercial purposes beyond personal use
All trademarks, service marks, and trade names associated with Genesis AI are
the property of the Proprietor.

4. USER OBLIGATIONS

The User agrees to:
- Use the Service in compliance with all applicable laws and regulations
- Refrain from generating content that is illegal, harmful, threatening,
abusive, or otherwise objectionable
- Not attempt to gain unauthorized access to any part of the Service or
its underlying systems
- Not use the Service to generate or disseminate malicious code, viruses,
or other harmful materials
- Not engage in activities that interfere with or disrupt the Service
- Not harvest or collect personal data from other users
PROHIBITED CONTENT:
The following categories of content are strictly prohibited:
- Criminal activity or instructions for committing crimes
- Violence or threats of physical harm
- Harassment, defamation, or hate speech
- Sexual content or explicit material
- Fraud, scams, or deceptive practices
- Misinformation or disinformation
- Content that infringes intellectual property rights
- Terrorism or extremist content
- Child exploitation material
- Spam or unsolicited communications

5. SERVICE LIMITATIONS

5.1 GENERAL LIMITATIONS:
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Proprietor
makes no warranties, express or implied, regarding the Service's reliability,
accuracy, or availability.
The Service is experimental in nature and may produce unexpected or incorrect
outputs. The Proprietor does not guarantee that the Service will be
uninterrupted or error-free.
The User accepts all risks associated with using the Service, including any
reliance on the accuracy or reliability of outputs.
The Proprietor reserves the right to modify, suspend, or discontinue any part
of the Service at any time without prior notice.

5.2 AI OUTPUT AND ACCURACY DISCLAIMER

The User acknowledges that the Service utilizes experimental artificial
intelligence logic and rule-based systems. Content generated by the AI may
occasionally be inaccurate, incomplete, or biased. All outputs are for
informational purposes only and must not be used as professional, legal,
medical, or financial advice. The Proprietor is not liable for any decisions
made based on AI outputs. The User is responsible for verifying all
information before use. THE SERVICE IS PROVIDED "AS IS" WITHOUT ANY
WARRANTIES, EXPRESS OR IMPLIED.

6. DATA AND PRIVACY

The Service processes data locally within the User's browser. User Content is
not transmitted to external servers except where necessary for specific
features.
MINIMAL DATA COLLECTION:
- Chat messages are stored locally in IndexedDB
- User preferences are stored in LocalStorage
- Theme settings are stored in LocalStorage
- Profile information (if Google Sign-In used) is stored locally
- No analytics or tracking is performed
The Proprietor does not maintain any central database of User communications
or personal data. All processing occurs on the User's device.

7. THIRD-PARTY SERVICES

The Service integrates with third-party services for specific features.
Each third-party service has its own privacy practices:
IMAGE GENERATION:
- Provider: Puter.js
- Data transmitted: Text prompts only
- Users acknowledge this feature requires external transmission
GOOGLE SIGN-IN:
- Provider: Google LLC
- Data transmitted: Authentication tokens
- Subject to Google's Privacy Policy
VOICE RECOGNITION:
- Provider: Browser Vendor (via Web Speech API)
- Data processed: Audio input (processed locally by browser)
- Subject to browser vendor's privacy policy
WEB HOSTING:
- Provider: GitHub Pages
- Standard server logs may be recorded
- Subject to GitHub's Privacy Policy
The Proprietor is not responsible for the data practices of third-party
providers. Users should review the respective privacy policies of these
providers.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL JAMES TURNER
(XPDEVS) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL,
OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO:
- THE USE OF OR INABILITY TO USE THE SERVICE
- ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS
- ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE
- ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED
TO OR THROUGH THE SERVICE
- ANY ERRORS, OMISSIONS, OR INACCURACIES IN ANY CONTENT OR INFORMATION
THIS LIMITATION APPLIES REGARDLESS OF WHETHER THE LIABILITY IS BASED ON
BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY
OTHER THEORY.
THE USER EXPRESSLY ACKNOWLEDGES THAT THE PROPRIETOR SHALL NOT BE LIABLE
FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF
ANY THIRD PARTY.

9. INDEMNIFICATION

The User agrees to indemnify, defend, and hold harmless the Proprietor and
its officers, directors, employees, agents, and affiliates from any and
all claims, damages, liabilities, costs, and expenses (including reasonable
legal fees) arising from:
- The User's breach of this Agreement
- The User's violation of any law or the rights of a third party
- The User's misuse of the Service
- The User's User Content
- The User's access to or use of the Service
The Proprietor reserves the right, at the User's expense, to assume the
exclusive defense and control of any matter for which the User is required
to indemnify the Proprietor, and the User agrees to cooperate with the
Proprietor's defense of these claims.

10. TERMINATION

The Proprietor reserves the right to terminate or suspend the User's access
to the Service at any time, without prior notice, for any reason including
but not limited to:
- Violation of this Agreement
- Violation of any applicable laws or regulations
- Request by law enforcement or other governmental agencies
- Discontinuation of the Service
- Security concerns
Upon termination, the User's right to use the Service immediately ceases.
The Proprietor shall not be liable to the User or any third party for
termination of access to the Service.

11. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the
laws of England and Wales, without regard to its conflict of law provisions.
Any disputes arising under this Agreement shall be subject to the exclusive
jurisdiction of the courts of England and Wales, and the User hereby consents
to the jurisdiction of such courts.
SEVERABILITY:
If any provision of this Agreement is held to be invalid or unenforceable,
the remaining provisions shall continue in full force and effect. The
invalid provision shall be modified to the minimum extent necessary to
make it valid and enforceable while preserving the original intent.
WAIVER:
The failure of the Proprietor to enforce any right or provision of this
Agreement shall not constitute a waiver of such right or provision.
ENTIRE AGREEMENT:
This Agreement, together with the Privacy Policy and any other legal
notices published by the Proprietor, shall constitute the entire agreement
between the User and the Proprietor regarding the Service.
